Dallas County, Texas. 2006.

Case:

Client, a mentally-ill and incompetent inmate is severely neglected during his incarceration at the Dallas County Jail.

Client is transported to a local hospital and he remained on life-support for several months. Client eventually makes a partial recovery.

Attorney Finn is contacted by the client’s family and agrees to investigate the situation. Finn, who has been very critical of the quality of care in the Dallas County Jail, is able to obtain a copy of a scathing Internal Affairs Report

which details the horrific conditions of the jail. Finn immediately contacts federal authorities and he shares the IAD Report with the United States Department of Justice in Washington, D.C.

Finn then brings two exceptional civil litigators to the team, Jeff Kobs & Mark Haney, Fort Worth.

Finn, Kobs, and Haney file a civil rights lawsuit in federal court on behalf of Client and two other inmates who were also mistreated.

The County assures the public that the lawsuit if frivolous and that all is well with the jail. The County also remains confident that the County’s legal team, partners at one of the most prestigious civil law firms in Texas, will have the case tossed out of court via summary judgment. Discovery unfolds, depositions are taken, and motions are filed.

The County loses summary judgment. The case gets set for a jury trial.

The Civil Rights Division of the Department of Justice launches an official investigation and issues a very critical report which lists a number of “life-threatening” conditions present in the jail.

The Department of Justice informs Dallas County that if it doesn’t get its act together and fix the jail that DOJ is prepared to intervene and fix it themselves.

Dallas County finally decides to begin to implement the recommendations outlined by the Department of Justice.
Result:

The case settles for $950,000.00.  James Monroe Mims, et. al., v. Dallas County.

Dallas Division, Northern District of Texas. July 2007.

Note: The County spent more than $1.5 million dollars defending this case.
